Xeda/Pace lose appeal for DPA EU approval

French company Xeda International and US firm Pace International have lost their appeal against a court ruling that upheld the EU decision not to re-register the fungicide, diphenylamine (DPA). The companies had appealed against an EU General Court decision in 2012 (Agrow No 638, p 9). However, the European Court of Justice (ECJ) has agreed with the earlier Court view that the European Commission was justified in basing its decision on concerns over data gaps. DPA is used for post-harvest treatment of fruit and vegetables, but was phased out in the EU in 2011 after failing to gain re-registration.
