Brazil state suspends injunction against Syngenta agchems
The Brazilian Rio Grande do Sul state Supreme Court has this month granted a suspension to an injunction. The injunction was imposed on the sale of Syngenta's herbicides, Gramoxone 200 and 400 Gramocil (both paraquat). and the fungicide, Mertin (fentin hydroxide). The request was made after the company had a registration application turned down by the state’s environmental agency, the Fepam. The injunction was overturned by the 21st Chamber on “contradiction of defence rights” grounds. The state’s public prosecutor was enacting powers it claimed could supersede federal law, and allow states to impose higher requirements on health and environmental concerns.
