BASF wins Brazil patent case
BASF has won a patent infringement case for its fipronil-based insecticides in Brazil. The 12th Civil Court of Sao Paulo found for BASF in the first instance in November 2009 against Brazilian pesticide company, Insetimax (Sao Paulo). The decision bans Insetimax from marketing fipronil-based insecticides in Brazil, including its product, Bioinsect 125. BASF launched the case against Insetimax last year, gaining an injunction in July ( Agrow No 576, p 4). The multinational has identified several products marketed in Brazil that are based on the active ingredient, and started several legal actions against companies for infringing its patent, it says. It won an injunction last year against another Brazilian company for use of the same ai in another insecticide product ( Agrow No 539, p 2).
