Legal opinion rejects action against EU patent
Spain’s legal challenge against the new legislation setting up an EU-wide patent system must be dismissed, says Yves Bot, advocate general at the EU Court of Justice (ECJ). Spain had sought annulment, claiming that national powers would be reduced, and that the limit of three official languages (English, French and German) was unfair. But Mr Bot considers that a unified patent would provide genuine benefits for businesses, including considerable savings in translation costs. His opinion will go forward for consideration by the ECJ.
