Mixed views on latest US permit case

US industry groups have given a mixed reaction to the latest court ruling on the need for Clean Water Act (CWA) permits for certain pesticide applications. The Second Circuit Court of Appeals ruled that the application of mosquito control products to wetlands on Long Island, New York, was legal. CropLife America (CLA) and its non-crop pesticide arm, RISE, welcome the ruling but are concerned that the three-judge panel defined the application equipment as a “point source” under the CWA.
