ECJ rejects lawsuit against ethoxyquin withdrawal
French company Xeda International has lost a court case seeking to annul a European Commission decision in 2011 not to re-register the fungicide, ethoxyquin. The active ingredient was phased out in September 2012 after an evaluation under the EU review of existing ais. Xeda claimed that the decision was based on “hypothetical concerns” and had failed to take account of all available data. But the General Court of the European Court of Justice (ECJ) agreed with the original conclusion of the Commission that there were insufficient data to complete the risk assessment for the ai.
