US EPA issues draft NPDES permit

The US EPA has issued its proposed general permit governing the application of pesticides over or near water. The general National Pollutant Discharge Elimination System (NPDES) permit is necessary to ensure that pesticide applicators comply with the Clean Water Act (CWA). The Agency had to develop the permit after the Sixth Circuit Court of Appeals overturned the EPA’s 2006 rule exempting pesticide applicators from NPDES permits ( Agrow No 559, p 14). That ruling was stayed until April 9th 2011 to allow the Agency time to draw up the general permit ( Agrow No 570, p 13).
