French ban on MON810 illegal says EU lawyer

France acted illegally when it banned Monsanto’s EU-approved genetically modified insect-resistant MON810 maize in 2008, concludes an EU lawyer. Paolo Mengozzi, attorney general at the European Court of Justice (ECJ), delivered his view in March. The ECJ was asked for an opinion by the French council of state, the Conseil d’Etat, after the ban was challenged by Monsanto. The ECJ has yet to make a final ruling but usually follows the opinions of the attorney general. The case is likely to cause further legal uncertainty over European Commission plans to give member states more freedom to block the cultivation of EU-approved GM crops.
