Fersol claims Brazil methamidophos injunction remains in force

Brazilian agrochemical company Fersol (Mairinque) claims that the Brazilian authorities are wrong to say that its injunction, allowing it to continue producing the insecticide, methamidophos, has been suspended. The Brazilian national health surveillance agency, the Anvisa, won an appeal against the July injunction ( Agrow No 624, p 13). Fersol president Michael Haradom contests this version of the case. “The Anvisa predictably appealed against the injunction during the public holiday period to the federal capital regional court, the TRF, when a substitute judge granted a provisional decision in favour of the agency,” Mr Faradom says. “But the case is not closed as that provisional ruling has yet to be evaluated by three judges of the TRF,” he notes.
