Dow pursues EU court action for trifluralin
Dow AgroSciences is continuing to battle in the courts to restore the EU approval of its herbicide, trifluralin. The company has appealed against a September ruling by the EU General Court that upheld the European Commission’s decision in 2007 not to re-register the active ingredient ( Agrow No 624, p 7). Dow had challenged the 2007 decision on the grounds that the Commission had not taken account of all available data nor followed procedures. The Commission also decided against re-registration in 2010, after the company resubmitted its application for approval. Dow and Portuguese company Dintec Agroquimica have a separate lawsuit challenging the 2010 decision ( Agrow No 608, p 8).
