US industry counters "mega" ESA suit

The US industry association, CropLife America (CLA), and other parties have filed a motion to dismiss a lawsuit seeking widespread restrictions on pesticides under the Endangered Species Act (ESA). The so-called “mega” suit was filed against the EPA by environmentalist groups in January 2011 ( Agrow No 608, p 12). It claimed that the EPA had failed to consult with wildlife agencies on the effects of some 380 pesticides on 214 endangered or threatened species in 49 states.
