Bayer patent-infringing agchems destroyed
Dutch port authorities seized pesticides that infringed Bayer CropScience patents late last year and destroyed in January, the company says. The illegal products were destroyed on January 17th this year, Bayer says. Shipping line Hyundai Merchant Marine unknowingly transported the goods and has since been “very supportive and co-operative in organising the storage and destruction of the products”, Bayer adds. It later recovered costs from the shipper. The transportation of counterfeit products could lead to the liability of the carrier to pay for the cost of their storage and destruction, Bayer warns. It urges the exercise of due diligence such as checking labelling and validity of documentation when transporting such goods for the named parties: the Chinese shipper, Shenzen Most Enterprise Development (Shanghai), and the consignee, Russian supplier Agrotechnologies (Smolensk).
