MEPs call for control on plant breeding patents

The European Commission must make sure that the interpretation of the EU biotechnology patents Directive (98/44 – Agrow No 500, p 9) does not limit innovation by smaller European plant breeders, says the European Parliament. Conventionallybred plants and the products derived from them must remain exempt from the law, MEPs stress. In a resolution passed in May, the Parliament draws attention to recent court cases involving the European Patent Office, claiming that these indicate that patent protection is becoming “excessively broad”. It reminds the Commission of its duty to report annually on the effects of Directive 98/44, and criticises the fact that no report has been published since 2005.
