Brazil GM soy royalties injunction goes national
The Brazilian High Court of Justice, the STJ, has ruled that a class action victory against Monsanto’s charging of royalties for the planting of saved genetically modified glyphosate-tolerant Roundup Ready soybeans applies nationally. It follows a ruling from a Rio Grande do Sul state court in April, which found for five farmers’ unions ( Agrow No 638, p 23). That granted an immediate injunction against the collection of all such royalties on GM soybeans produced in Brazil, with a failure to comply potentially costing a daily fine of R$1 million (US$489,000). It cited abuse of commercial power after the expiry of patents for the decision.
