Bayer enforces Nativo trade mark in Vietnam
Bayer CropScience has successfully enforced its trade mark for its rice fungicide, Nativo (trifloxystrobin + tebuconazole), in Vietnam against Vietnamese company Viet Duc (Tan Hiep). The Vietnamese company was selling crop protection products under its own trade mark, Natido, which looked very similar to Nativo. In February, Bayer requested the Vietnam Intellectual Property Institute (VIPRI) to examine whether the marketing of Natido infringed the trade mark of Nativo. After a positive VIPRI conclusion, Bayer filed a petition with Vietnam’s Ministry of Science and Technology, which conducted an inspection and confirmed the allegations. Infringed products will have to be withdrawn from the market and will be destroyed. Furthermore, Viet Duc is no longer allowed to use the Natido brand name, and has been fined.
