EU to appeal against residue review ruling
The European Commission is to appeal against a court ruling that could force a review of EU pesticide residues rules. In June, the EU General Court annulled the Commission’s rejection in July 2008 of requests for a review of EU Regulation 149/2008, which set up lists of temporary maximum residue limits (MRLs) until final EU-wide MRLs are set ( Agrow No 643, p 8). The original requests and lawsuit had been brought by the environmentalist groups, Stichting Natuur en Milieu and Pesticide Action Network Europe. But the Commission disputes the Court’s finding that the requests were valid under the Aarhus Convention, which covers public participation in decision-making on environmental matters. Its decision to appeal has been condemned by the European Environmental Bureau, which represents environmentalist organisations.
