US Supreme Court to hear Monsanto seed saving case

The US Supreme Court has agreed to hear a case in which a farmer was found to have infringed Monsanto’s biotechnology patents after planting soybean seed from a grain elevator. Last year, the US Court of Appeals for the Federal Circuit upheld a lower court’s ruling that “patent exhaustion” did not apply to the farmer’s “second-crop” plantings ( Agrow No 625, p 31).
