EU to widen scope of biocides review
The European Commission has proposed measures to add further active ingredients and products to the ongoing review of existing biocides initiated under the EU biocidal products Directive (98/8). The review covers a wide range of ais, including non-crop pesticides, divided into specific product types. However, different interpretations of the original rules mean that some products were not submitted for the original review because notifiers believed that they were not covered by the Directive. The correct interpretation was clarified in a 2012 EU court ruling that biocidal products also include those that act only by indirect means on the target harmful organisms. The Commission plans to give notifiers another chance to apply for EU approval of such products, otherwise they face the withdrawal of unregistered items.
