Monsanto loses patent case in Brazil
Monsanto has failed to “reactivate” the registration in Brazil of two patent requests for technology used in the production of genetically modified crops. The company applied for re-registration of both at the Brazilian intellectual property corporation, the INPI. Monsanto lost its case against the INPI at the federal court in Rio de Janeiro in June this year and its appeal of that judgement at the regional federal tribunal the following month. The court describes the decision as “unprecedented” in Brazilian jurisprudence.
