Bayer/DuPont contest safener deal
DuPont and Bayer CropScience are embroiled in two US lawsuits over a contract to supply Bayer’s herbicide safener, isoxadifen-ethyl, to DuPont. In 2006, Bayer agreed to supply the safener to DuPont for use in its maize herbicides as part of a wider technology access deal ( Agrow No 504, p 1). However, disagreements over the use of the safener led to Bayer filing a lawsuit against DuPont in North Carolina and DuPont suing Bayer for breach of contract in Delaware. Both lawsuits were filed on May 5th.
