MAI appeals against EU ruling on endosulfan

Makhteshim-Agan Industries (MAI) has appealed against an EU court ruling that upheld the withdrawal of the organochlorine insecticide, endosulfan. Last year, the EU Court of First Instance dismissed an application to overturn the European Commission's decision not to re-register the active ingredient ( Agrow No 552, p 10). MAI, along with Greek company Alfa Agricultural Supplies (Athens) and Spanish company Aragonesas Agro (Madrid), has appealed to the EU Court of Justice to set aside the judgement or refer the case back to the Court of First Instance. In the initial case, the applicants contended that the Commission had not considered all the data submitted, while the Commission argued that it had the right to ignore data submitted after the deadlines had passed.
