US EPA in new ESA deal

The US EPA has agreed to determine the effects of 74 pesticides on 11 endangered or threatened species in California over the next five years. The proposed stipulated injunction is aimed at settling a 2007 lawsuit by the Center for Biological Diversity (CBD). It had accused the Agency of violating the Endangered Species Act by failing to consult the Fish and Wildlife Service (FWS) on the effects of some 47 pesticides on a range of endangered species in the San Francisco Bay area ( Agrow No 521, p 11). The scope of the case was later extended to 74 pesticides.
