EU court OKs metalaxyl review
Spanish agrochemical company Industrias Quimicas del Valles (IQV - Barcelona) has won the backing of the European Court of Justice's (ECJ) advocate general in a case concerning the EU re-registration of the fungicide, metalaxyl. The advocate general has recommended that a verdict made in 2005 by the Court of First Instance (CFI) be overturned. The CFI upheld a European Commission decision in 2003 not to include the active ingredient in Annex I of the EU agrochemical registration Directive (91/414). However, the advocate general concludes that the CFI had incorrectly applied the Directive. His recommendations will be considered for a final ruling by the ECJ.
