ECJ (European Court of Justice) dismisses Austria genetically modified organisms ban

The European Court of Justice (ECJ) has ruled that Austria has no legal nor scientific basis for its ban on the cultivation of genetically modified crops. Austria had appealed against a similar ruling in 2005 by the EU Court of First Instance (Agrow No 482, p 12). In its September decision, the ECJ upheld the original ruling that Austria had failed to establish adequate grounds for banning GM crops that had been approved by the European Commission. It agreed that Austria could not use the presence of organic and small-scale farming as the basis for its action.
