US Judge throws out Nicaragua DBCP lawsuits
US fruit company Dole has won a dramatic court ruling against claimants seeking damages for exposure to the nematicide, dibromochloropropane (DBCP). Los Angeles Superior Court Judge Victoria Chaney found “systematic fabrication” of evidence from Nicaraguan plaintiffs. The claims were the by-product of “lawyers and corrupt Nicaraguan judges conspiring to perpetrate a blatant extortion of Dole and the other defendants”, she said. The other companies were Dow AgroSciences and American Vanguard. The judge “formally ordered dismissal with prejudice of the two remaining lawsuits” last month, Dole says.
