Judge tosses BPA suits against formula makers, but claims against bottle companies survive

A federal judge last week dismissed class action lawsuits filed against three companies that sell infant formula packaged in metal cans lined with bisphenol A, ruling that the consumer fraud claims were preempted by federal regulations imposed by FDA. But the judge refused to close the door on similar suits against manufacturers of baby bottles, sippy cups and sport bottles containing BPA, handing plaintiffs a partial victory in a growing legal battle over the controversial chemical.
