US court urged to reverse Hawaii county GM crop ban

Plaintiffs challenging the US state of Hawaii Maui County's ban on genetically modified crops have asked a federal court to grant them summary judgment, arguing that the local measure is clearly pre-empted by state laws. The motion filed last month notes that the same court has recently rejected two other local Hawaiian ordinances that aimed to regulate GM crops and pesticide use, ruling that both were pre-empted by state statutes and regulations. "It is clear that counties cannot regulate in an area where state law -- to the extent not pre-empted by federal law -- controls," say Monsanto, Dow AgroSciences’ subsidiary Agrigenetics and the others challenging the Maui ballot initiative.
