Dow challenges EU phase-out of 1,3-dichloropropene:

Dow AgroSciences has asked the European Court of First Instance to annul the European Commission's decision last year not to re-register the nematicide, 1,3-dichloropropene. The Commission set a phase-out date for the active ingredient of March 20th 2009, with an option to extend this for a further 18 months (Agrow No 530, p 9). Dow argues that the assessment procedures infringed the company's right of legal certainty and legitimate expectations. It points out that the rules laid down in 2000 on the second round of the EU review of existing ais were changed in 2002 to introduce the mandatory involvement of the European Food Safety Authority. Dow contests the evaluation report on the ai and says that additional data provided by the company were not considered in the final decision (Agrow No 521, p 7).
